A 'Defective Product' is one that causes some injury or damage to a consumer as a result of some flaw or weakness in labeling of the product, the way the product was used, or the product itself. Liability for injuries caused by a Defective Product lies in the hands of the manufacturer of the product that caused the injury, as well as those involved in the chain of commerce.
Persons injured by a 'Defective Product' are allowed some form of recovery in every state. 'Product liability' claims are cases dealing with damage due to a Defective Product that includes everything from obvious (a car sold without operational brakes, or a mislabeled product that causes injury) to less obvious (injury from exposure to tobacco, or harmful side effects from an improperly tested drug) incidents.
